In the ‘90’s, most American infants received up to 138X the EPA mercury guidelines
(62.5 mcg. Thimerosal) at one sitting. They would need to weigh 1375 lbs to ingest this amount or 1787 lbs to receive via injection.  Infants also received mercury at levels
more than 50X the EPA mercury guidelines at multiple other sittings.
 

 "There is a huge epidemic of autism and it is the vaccinations,"

 founder of the Autism Society of America.  The symptoms of mercury poisoning

According to EPA levels not likely to cause harm,
an infant or toddler would need to be a 275 lb. adult

AN ACT

To amend Chapter ___, ____, by adding thereto one new section
relating to immunizations.  

Section A. Chapter ____, ____ is amended by adding thereto one new section, to be
known as section ____, to read as follows:

1. within 180 days of the passage of this bill:  All immunizations administered to any person, including pregnant women, in the State of ______  shall at no point in the production process contain mercury, trace-amounts of mercury or preservatives containing mercury including but not limited to Thimerosal; and
 
2. The immunizations not containing mercury, trace-amounts of mercury or preservatives containing mercury including but not limited to Thimerosal, administered in the State of ____ , include, but are not limited to, immunizations recommended in the Childhood Immunization Schedule and the Influenza vaccine.

3. Within 180 days of the passage of this bill, any insurer doing business in the State of ______
that provides coverage for immunizations on a fee schedule or on a percentage reimbursement basis shall not reimburse for immunizations containing mercury, trace-amounts of mercury or preservatives containing mercury including but not limited to Thimerosal, and shall reimburse for immunizations not containing mercury, trace-amounts of mercury or preservatives containing mercury including but not limited to Thimerosal, at the same percentage rate of the usual and customary charges which were provided for immunizations prior to the passage of this legislation.
 

BAN VACCINE MERCURY Talking Points:

1) In the late 1980’s and early 1990’s, the number of vaccines in the childhood immunization schedule greatly increased, tripling the mercury level=. Babies in America were exposed to mercury up to 138 times levels not considered safe by the EPA for oral consumption by adults (1380 lb. to ingest, 1794 lb. to inject) injecting 187.5 mcg of Thimerosal into US infants by age 6 months - at the same time Sweden removed mercury & Thimerosal from their vaccines. During the next 10 years, autism skyrocketed (see chart above).  In 1997 Congress asked FDA to report on the level of mercury in vaccines and other products. In 1999, the FDA reported that vaccine levels were considerably above federal safety guidelines. At that point, the AAP, CDC, HHS, and FDA agreed mercury should be removed from childhood vaccines. There was no recall. Every shot in the pipeline was allowed to be shipped and used. By 2003, most American infant vaccines were becoming mercury free. In spring 2004, the CDC announced the 2004-5 flu shot would have mercury for infants as young as 6 months. Rep Weldon (R-FL) began legislation to ban mercury (HR4169) – with no matching legislation in US Senate. Grassroots efforts began in state legislatures nationwide.

3) Thimerosal was banned by FDA in over-the-counter (OTC) drug preparations because of questions over safety. (Federal Register: April 22, 1998 (Vol 63, Number 77) [Page 19799-19802].

4) Dr. Andrew Wakefield asks why it's in infant vaccines when, "mercury was taken out of animal vaccines 20 years ago because it was too toxic."  Dr. Stephanie Cave MD says, "Mercury poisoning and autism have nearly identical symptoms: self-injurious behavior, social withdrawal, lack of eye contact, lack of eye contact, lack of facial expression, hypersensivity to noise and touch, and repetitive behaviors."

5) In January 2004, the nation’s pediatricians received an autism ALARM [an acronym for an American Academy of Pediatrics communication program -- also sent out by CDC] stating Autism Spectrum Disorders (ASD) were affecting 1 in 166 children (90 percent of them are boys). Behavior/Developmental disorders were affecting 1 in 6 children.  Both are epidemic.  Autism rose over 1000% 1991-2004. 6) Given the CDC/ AAP  A.L.A.R.M. numbers, that means that out of 4 million born in US each year, 24,000 will be devastated with autism, and perhaps as many as 600,000 with mild to severe learning disorders, caused in part or whole by neurological destruction of brain cells that mercury is proven to precipitate. According to Dr. Mark Geier, who has studied the CDC's own data, "Kids who received 100 mcg of thimerosal were over ten times more likely to have autism than the kids who received no mercury containing vaccines.

7) A 1991 Merck memo (just released publicly Feb. 8, 05) shows that at least one major manufacturer was aware of the vaccine mercury concern much earlier. The 1991 memo stated 6-month-old children who received their shots on schedule would get a mercury dose up to 87 times higher than guidelines (FDA) for the maximum daily consumption of mercury from fish. "When viewed in this way, the mercury load appears rather large," said the memo from Dr. Maurice R. Hilleman, an internationally renowned vaccinologist to the president of Merck's vaccine division. "It is reasonable to conclude" that it should be eliminated where possible, he said, "especially where use in infants and young children is anticipated." Apparently, no one at the National Immunization Program (NIP) within CDC (or the FDA) did the calculations regarding the cumulative mercury exposure. (LA Times Feb. 8, 05)        

8) A turning point came in 1997 when Congress passed a bill ordering an FDA review of mercury ingredients in food and drugs. Completed in 1999, the review was described at the time as a first effort to assess the cumulative mercury dose. In e-mails released at a congressional hearing, an FDA official said health authorities could be criticized for "being 'asleep at the switch' for decades by allowing a potentially hazardous compound to remain in many childhood vaccines, and not forcing manufacturers to exclude it from new products." It would not have taken "rocket science" to add up the amount of exposure as the prescribed number of shots was increasing.

10) Rep. Weldon, the only physician in US House of Representative continues to question whether neurological problems were caused in some children by the high level of mercury contained in many vaccines in the 1990's. In his 2005 THE HILL article, Rep Weldon, MD (R-FL) states: "Unfortunately it remains in the childhood flu vaccine, and I will again introduce legislation to eliminate mercury from this vaccine." 11)  Although they afflict widely different age groups, autism and Alzheimer’s share a common cause: mercury. Dr. Boyd Haley, professor and chair of the chemistry department at the University of Kentucky, and Dr. Bernard Rimland, founder of the Autism Research Institute, presented evidence at this year’s Doctors for Disaster Preparedness meeting that connects mercury with these diseases. This heavy metal is highly poisonous. A Dartmouth professor studying the chemical characteristics of an organic form of mercury – dimethyl mercury – spilled two drops of it on her gloved hand. The first sign of mercury poisoning occurred four months later when her speech began to be slurred. This was followed by difficulty walking and loss of vision. She then fell into a coma and died. Another person, attempting to smelt the silver in dental amalgams, heated them in a frying pan. The mercury vapor thus generated killed him quickly. 12) Report: Autism: A Unique Form of Mercury Poisoning: Bernard, et al -- A review of medical literature indicates that the characteristics of autism and of mercury poisoning (HgP) are strikingly similar. 13) A University of Calgary Faculty of Medicine research team has found that exposure to mercury causes degeneration of brain neurons in animals. 14) ‘“More than one child in six born in the United States could be at risk for developmental disorders because of mercury exposure in the mother's womb,” according to estimates released last week by EPA scientists. The agency doubled its estimate, equivalent to 630,000 of the 4 million babies born each year.’  E.P.A. 15) Study evaluated concentrations of mercury in urine following a 3-Day treatment with an oral chelating agent. Overall urinary mercury concentrations were significantly higher in 221 children with Autism Spectrum Disorders than in 18 normal controls. 16) EPA Methyl-Mercury RfD derived in 2003 is 0.1 ug / kg (2.2 lbs) per day. 25 mcg. of mercury is considered "safe" for a 550 lb. adult using EPA guidelines for ingestion. 17) Additional Facts: ● 15% of women in America (Rh Neg) get Rhogam shots and have 50% of autistic children. The Rhogam shots often have 25-35 mcg. of Thimerosal. ● Scientists put brain cells in Petri dishes. To some they added mercury, some estrogen and mercury, and others testosterone and mercury. The mercury was very toxic. The estrogen somehow protected cells for only 3% cell death. Testosterone & mercury was much more lethal than mercury alone, explaining why boys get autism 4 to 1 more than girls. ● In a study by Dr. William Walsh, Ph.D. of the Pfeiffer Center, of 503 children with autism, ALL but four showed a Metallothionein (MT) Dysfunction. The lack of MT signifies the inability to metabolize mercury out of the body. Even though MT deficiency may be constant in the gene pool, what changed was tripling of mercury-load in vaccines, and autism rose over 1000%. ● Mercury is a heavy metal & poison, proven to be more toxic than lead or arsenic, and is the most toxic, non-radioactive element on Earth.

18) According to Hugh Fudenberg, MD, the world's leading immunogeneticist and 13th most quoted biologist of our times (nearly 850 papers in peer review journals): If an individual has had 5 consecutive flu shots between 1970 and 1980 (the years studied) his/her chances of getting Alzheimer's Disease is 10 times higher than if he/she had one, 2 or no shots. Dr. Fudenberg said it was due to mercury and aluminum that is in every flu shot (and was in most childhood shots). The gradual mercury and aluminum buildup in the brain causes cognitive dysfunction. Flu shots contain 25 micrograms of mercury. One microgram is considered toxic.

19) Professor John Oxford of Queen Mary's School of Medicine and Dentistry states: From Alzheimer's disease to a devastating lineup of other neurological disorders including Parkinsons, ALS, MS, autism and AD - mercury is known to be a potent neurotoxin that either is the prime cause of such disorders or certainly is seen to exacerbate them [xxix]. He says, If there is "any doubt whatsoever" about the safety of mercury in vaccines then it should be removed. 

20) It costs $2 more per $20-80 vaccine for mercury-free, however the cost in personal trauma to these 24,000 American children / year who acquire Autism and their families, plus the economic burden is immeasurable. Autism IS Treatable with proper biomedical interventions – however only 2% will receive chelation to remove the 6 times more mercury found in children with autism than normal children. Chelation along with much nutritional support will bring 50-70% of this 2% to normal range. Without chelation and biomedical interventions, 75% ultimately become wards of the states.

We ask the State Legislature to please remove all Thimerosal from ALL Vaccines.

   Mercury is a known neurotoxin and its mechanism of neurotoxicity has been studied in our laboratory for the past 10 years.  In human brain homogenates we had earlier observed that mercuric ion rapidly inhibited tubulin viability at low micromolar levels mimicking the situation in Alzheimer's diseased brain... It is my hypothesis that thimerosal releases ethyl mercury which most certainly interferes with neurite growth and neuronal development in infants. This supports the concept that thimerosal in biological solutions injected into the human body could cause a number of systemic problems identified as disease states. Both ethyl mercury and Hg2+ are very neuro toxic compounds. However, ethyl mercury is more rapidly partitioned into the hydrophobic (fatty) tissues of the central nervous system and is a more potent neuro toxin than Hg2+ based on this "partitioning factor". It is this partitioning factor that makes organic mercurials such as dimethyl mercury so neuro toxically lethal (this is the compound that caused the death of a Dartmouth University chemistry professor after she was exposed to a drop or two on her gloved hand).
    
8. Assessment of the impact of thimerosal on childhood neurodevelopmental disorders.

   The purpose of this study was to evaluate whether mercury from thimerosal in childhood vaccines contributed to neurodevelopmental disorders. The dosage of mercury children received in comparison to the FDA's maximum permissible dose for the oral ingestion of methyl mercury was determined. The dose-response curves showed increases in odds ratios of neurodevelopmental disorders from both the CDC Vaccine Adverse Event Reporting System (VAERS) and US Department of Education data closely linearly correlated with increasing doses of mercury from thimerosal-containing childhood vaccines and that for overall odds ratios statistical significance was achieved.

    Autism is a syndrome characterized by impairments in social relatedness, language and communication, a need for routine and sameness, abnormal movements, and sensory dysfunction. Mercury (Hg) is a toxic metal that can exist as a pure element or in a variety of inorganic and organic forms and can cause immune, sensory, neurological, motor, and behavioral dysfunctions similar to traits defining or associated with autism. A review of medical literature indicates that the characteristics of autism and of mercury poisoning (HgP) are strikingly similar. Traits defining or associated with both disorders are summarized in Table A immediately following the Table of Contents and are discussed and cited in the body of this document. The parallels between the two diseases are so thorough as to suggest, based on total Hg injected into U.S. children, that many cases of autism are a form of mercury poisoning.

    Purpose of study to evaluate concentrations of mercury in urine following a 3-Day treatment with an oral chelating agent. Overall urinary mercury concentrations were significantly higher in 221 children with Autism Spectrum Disorders than in 18 normal controls. Regardless of the mechanism by which children with Autism Spectrum Disorders have high urinary mercury concentrations after chelation, the DMSA treatment described in this study might be useful to diagnose their present burden of mercury. The authors conclude DMSA appears to be an effective and safe chelating agent for treatment of pediatric overexposure to metallic mercury.

    Scientists have identified a signature metabolic impairment or "biomarker" in autistic children that strongly suggests that these children would be susceptible to the harmful effects of mercury and other toxic chemical exposures (James 2004a). Autistic children showed a significant impairment in every one of five measurements of the body's ability to maintain a healthy glutathione defense. These new findings significantly strengthen the possibility that mercury could cause or contribute to autism and other neurodevelopmental disorders by identifying a metabolic imbalance common to nearly all autistic children that would make these children poorly equipped to mount a defense against a number of neurotoxic compounds, including mercury.

    According to Dr. David Kessler, former head of FDA, "Only about 1% of serious events (adverse drug reactions) are reported to FDA." [iv] The general rule of thumb is between 10% [v] to 20%. The production of disease by the prescriptions of physicians is what is usually meant by Iatrogenic. Given the CDC A.L.A.R.M. numbers, that means that out of 4 million born in US each year, 24,000 will be devastated with autism, and perhaps as many as 600,000 with mild to severe learning disorders, caused in part or whole by neurological destruction of brain cells that mercury is proven to precipitate. According to Dr. Mark Geier, who has studied the CDC's own data, "Kids who received 100 mcg of thimerosal were over ten times more likely to have autism than the kids who received no mercury containing vaccines. Dr. Mark Geier and his son David Geier calculated the over neurodevelopmental damage that can be sourced to mercury toxicity to be approximately 2,402,505 cases [xiv]. Mercury is a cumulative poison, and used with other toxic substances in medicine, like aluminum, antibiotics, and formaldehyde, create lethal and semi-lethal cocktails that damage human life. ..One of the greatest mistakes made y modern medical science is the practice of injecting thimerosal into newborns and infant toddlers. ..Doctors compound the problem with the practice of injecting as many as nine vaccines into a child during a single office visit. Dr. Andrew Wakefield asks why it's still in infant vaccines when, "Mercury was taken out of animal vaccines 20 years ago because it was too toxic."  Professor John Oxford of Queen Mary's School of Medicine and Dentistry states: From Alzheimer's disease to a devastating lineup of other neurological disorders including Parkinson's, ALS, MS, autism and AD - mercury is known to be a potent neurotoxin that either is the prime cause of such disorders or certainly is seen to exacerbate them [xxix]. If there is "any doubt whatsoever" about the safety of mercury in vaccines then it should be removed.

    A University of Calgary Faculty of Medicine research team has found that exposure to mercury causes degeneration of brain neurons in animals. The scientific findings are being published in a cover story in the April edition of the British journal NeuroReport. The researchers’ academic paper is supported by a time-lapse video recorded from a microscope camera showing how neurons degenerate when they are exposed to mercury.

Search for association between mercury and cardiovascular disease revealed 358 scientific papers exemplifying the relationship. Mercury has clearly been shown to cause a denudation of the neurofibrils resulting in direct damage to neuronal cells.

    In August 1999, the Committee on Government Reform initiated an investigation into Federal vaccine policy. Over the last six months, this investigation has focused on possible conflicts of interest on the part of Federal policy-makers. Committee staff has conducted an extensive review of financial disclosure forms and related documents, and interviewed key officials from the Department of Health and Human Services, including the FDA and the CDC. This staff report focuses on two influential advisory committees utilized by Federal regulators to provide expert advice on vaccine policy: 1. The FDA’s Vaccines and Related Biological Products Advisory Committee (VRBPAC); and 2. The CDC’s Advisory Committee on Immunizations Practices (ACIP). The VRBPAC advises the FDA on the licensing of new vaccines, while the ACIP advises the CDC on guidelines to be issued to doctors and the states for the appropriate use of vaccines. Members of the advisory committees are required to disclose any financial conflicts of interest and recuse themselves from participating in decisions in which they have an interest. The Committee’s investigation has determined that conflict of interest rules employed by the FDA and the CDC have been weak, enforcement has been lax, and committee members with substantial ties to pharmaceutical companies have been given waivers to participate in committee proceedings.

    Rep. Weldon, the only physician in the US House continues to question whether neurological problems were caused in some children by the high level of mercury contained in many vaccines in the 1990's. Rep Weldon outlines the flaws in May 2004 IOM report - about which he says he has never seen a report so badly miss the mark in his ten years of service in US Congress. The greatest outrage, he says is that it calls for a halt to further research (about a possible link between vaccines and neurodevelopmental disorders). Weldon  takes a detailed look at the five studies the IOM used as basis for their decisions, including serious conflicts of interest by the principal authors of all five studies. Three studies were of children within the Danish population that are genetically homogenous, and had significantly lower thimerosal exposures. All three Danish studies had authors that worked for Staten Serum Institute, the government owned vaccine manufacturer. Only 1 study of US children did NOT compate those with no mercury to those with exposures. Study five is unpublished, so public can't evaluate, plus again looks at a population of children (UK) outside the US, receiving lower levels of Thimerosal. Children in UK were exposed to 75 mcg Thimerosal by 4 months. This represents about one-half of what children in US would have been exposed to by this age, plus children in US got another 50 mcg two months later, at age 6 months for a total exposure in the first 6 months of life nearly 2 1/2 times what children received in the UK.     Thimerosal contains 49.6% mercury by weight and releases ethyl mercury as a metabolite. In the body ethyl mercury can be converted to inorganic mercury, which then preferentially accumulates in kidneys and brain (Blair, et al 1975). In this study we demonstrate that Thimerosal in micromolar concentrations rapidly decreases cellular viability, induces DNA breaks and membrane damage. Nueronal cell cultures demonstrated higher sensitivity to Thimerosal than fibroblasts.

    To examine vaccines as risk factors in autism, we conducted a study of serology (antibody levels) to three vaccines: MMR, DPT and DT (diphtheria-tetanus). Through our experimental research [8], we found that the level of MMR antibodies was significantly higher in autistic children as compared to normal children or other disease children [Fig. 2]. Furthermore, we characterized that this abnormal MMR serology was due to antibodies to measles subunit but not the mumps or rubella subunit of the trivalent vaccine MMR [8]. These findings led me to speculate that the measles subunit of the MMR vaccine might trigger an autoimmune reaction in a significant number of autistic children [7-9]. Vaccines are well known to cause numerous adverse reactions in humans and no matter how rare they might be it is time to pay a closer attention to them. We need new policies simply because the existing policies are not in line with our modern knowledge of human immunology, virology, and genomics. At this juncture, I would also like to recommend a new policy of “Testing immunity before vaccination or immunization” that should help identify immunocompromised children who otherwise might react adversely to vaccines. The cost should not deter us from implementing this policy especially when the lives of hundreds and thousands of children and their families are concerned.

    A concentration of 1:10,000 is equivalent to a 0.01% concentration. Thimerosal is approximately 50% mercury (Hg) by weight.  A 1:10,000 concentration contains 25 micrograms of Hg per 0.5 mL.   i.e.  1:10,000 = .01% = 25 mcg. of Hg per 0.5 mL   Fluzone: The Fluzone vaccine package insert states: “Fluzone vaccine is supplied in a 0.5 mL prefilled syringe and 5 mL vial of vaccine, both of which contain the preservative thimerosal [(mercury derivative), (25 mcg mercury per dose)]. " Children 6-to-35-months old actually are supposed to receive half the dose, if the healthcare practitioner reads the instructions, or 12.5 mcg. of mercury in the injection. However, there is a pediatric .25 mL prefilled syringe with a trace amount.  Note that 12.5 mcg. of mercury is considered "safe" for an approximately 275 lb. adult using EPA guidelines for ingestion – and "safe" for an approximately 366 lb. adult for injection. (Injection is 1/3 more lethal than injection since absorbsion is much slower with ingestion. The 2004-5 influenza vaccine is scheduled for infants to receive twice during year one, (at 6 months & 7 months) then once per year thereafter. The 2004-5 influenza vaccine provides 25 mcg. of Thimerosal for pregnant moms, older children, seniors and all others regardless of weight and using EPA mercury guidelines is considered "safe" for an approximately 550 lb adult to ingest, 733 lb adult via injection.

  SECTION 1.  Article 9 (commencing with Section 124172) is added to Chapter 3
of Part 2 of Division 106 of the Health and Safety Code, to read:

      Article 9.  Mercury-containing Vaccines

   124172.  (a) Except for an influenza vaccine described in subdivision (b), on and after July 1, 2006, a person who is knowingly pregnant or who is under three years
of age shall not be vaccinated with a mercury-containing vaccine or injected with a mercury-containing product that contains more than 0.5 micrograms of mercury
per 0.5 milliliter dose.

   (b) On and after July 1, 2006, a person who is knowingly pregnant or who is under three years of age shall not be vaccinated with a mercury-containing influenza vaccine that contains more than 1.0 microgram of mercury per 0.5 milliliter dose.

   (c) The Secretary of the Health and Human Services Agency may exempt the use of a vaccine from this section if the secretary finds, and the Governor concurs, that an actual or potential bioterrorist incident or other actual or potential public health emergency, including an epidemic or shortage of supply of a vaccine that would prevent children under three years of age and knowingly pregnant women from receiving the needed vaccine, makes necessary the administration of a vaccine containing more mercury than the maximum level set forth in subdivision (a), or subdivision (b) in the case of influenza vaccine.  The exemption shall meet all of the following conditions:

   (1) It shall not be issued for more than 12 months.

   (2) At the end of the effective period of the exemption, the secretary may issue another exemption for up to 12 months for the same incident or public health emergency, if the secretary makes a determination that the exemption is necessary as set forth in this subdivision, the Governor concurs with the exemption, and the secretary notifies the Legislature and interested parties pursuant to paragraphs (3), (4), and (5).

   (3) Upon issuing an exemption, the secretary and the Governor shall, within 48 hours, notify the Legislature about the exemption and about the secretary's findings justifying the exemption's approval.

   (4) Upon request for an exemption, the secretary shall notify interested parties, who have expressed their interest to the secretary in writing, that an exemption request has been made.

   (5) Upon issuing an exemption, the secretary shall, within seven days, notify interested parties, who have expressed their interest to the secretary in writing, about the exemption and about the secretary's findings justifying the exemption's approval.

AN ACT

To amend chapter 191, RSMo, by adding thereto one new section relating to immunizations.

Be it enacted by the General Assembly of the state of Missouri, as follows: Section A. Chapter 191, RSMo, is amended by adding thereto one new section, to be known as section 191.235, to read as follows:

191.235. 1. Beginning January 1, 2006, immunizations administered in the state of Missouri to children less than eight years of age shall not contain any mercury preservatives, including but not limited to thimerosal. The Food and Drug Administration's designation as thimerosal free or trace only shall comply with this section. All other persons receiving immunizations that are not designated as thimerosal free or trace only shall be informed in advance that it contains a mercury-based preservative.

2. Beginning January 1, 2006, any insurer doing business in the state of Missouri that provides insurance coverage for immunizations on a fee schedule or on a percentage reimbursement basis shall reimburse for immunizations not containing mercury at the same percentage rate of the usual and customary charges which were provided for immunizations containing mercury or other preservatives immediately prior to January 1, 2006.

3. The director of the department of health and senior services shall receive exemption from compliance with this section by providing documentation of an outbreak requiring a public vaccination program for which there does not exist a sufficient supply of vaccine free of mercury preservative, as required in subsection 1 of this section. The duration of such exemption shall be determined by the director. Such documentation shall be submitted to the chairs of committees of the house of representatives and the senate whose jurisdiction covers public health policy. Persons receiving an exempted immunization shall be informed in advance that it contains a mercury-based preservative.
