This gives you the option of what level of effort and involvement you wish to take in working with your state legislature.  For most, the basic Vaccine MERCURY BAN is the logical first step (see legislative text below). You may however feel you have the energy and networking ability to take the second step toward banning both Vaccine and Dental Mercury

If you decide to work a Dental Mercury Ban please contact Charlie Brown the attorney leading Consumers for Dental Choice: www.toxicteeth.org  Get a copy of "Dentist The Menace" from Charlie.  Talk to him about the different strategies to dental mercury ban: One includes the effect on our children -- causal link between mercury and autism, i.e. autism starts with the mother's teeth mercury.  Another is environmental -- 40 tons of mercury is purchased for dental practices each year in the U.S.  The silver amalgams are 50% mercury and 25% silver. Yes, the ADA has acknowledged they do leach out into the human carrier (although they say it's so small as to be insignificant). And yes, most returns to the environment in one way or another.  1 gram of mercury is enough to contaminate a small lake making fishing untenable.  40 tons is used in the U.S. each year! 

Remember, since this is your state, and you're doing most the work, we want to provide the best possible Model Legislative Text so you can work toward exactly the legislation you want in your state.  However, anything more than a simple Vaccine MERCURY BAN is going to take extra work on your part. 

Finally, we're considering a legislation to ban all medicinal mercury including vaccines.

In 2003 in CT, they passed ZERO MERCURY in all products (although it excluded medical and vaccines) -- it seems to take in all other products/uses including dental.  (Contact is Joe Martinez -- www.toxicteeth.org

STATE OF ________

GENERAL ASSEMBLY

HOUSE BILL NO. ______


AN ACT

To amend Chapter ___, ____, by adding thereto one new section
relating to immunizations.  

Section A. Chapter ____, ____ is amended by adding thereto one new section, to be
known as section ____, to read as follows:

1. within 180 days of the passage of this bill:  All immunizations administered to any person, including pregnant women, in the State of ______  shall at no time in the production process  contain mercury, trace-amounts of mercury or preservatives containing mercury including
but not limited to Thimerosal; and
 
2. The immunizations not containing mercury, trace-amounts of mercury or preservatives containing mercury including but not limited to Thimerosal, administered in the State of ____ , include, but are not limited to, immunizations recommended in the Childhood Immunization Schedule and the Influenza vaccine.

3. Within 180 days of the passage of this bill, any insurer doing business in the State of ______
that provides coverage for immunizations on a fee schedule or on a percentage reimbursement basis shall not reimburse for immunizations containing mercury, trace-amounts of mercury or preservatives containing mercury including but not limited to Thimerosal, and shall reimburse for immunizations not containing mercury, trace-amounts of mercury or preservatives containing mercury including but not limited to Thimerosal, at the same percentage rate of the usual and customary charges which were provided for immunizations prior to the passage of this legislation.

 

 


DENTAL MERCURY BAN
(aimed at Health Committee - because of mercury-autism connection)


Title: “Prohibit Mercury in Dental Fillings for Pregnant Women, Lactating Women, and Children Under Six, and Give Disclosure and Choice to All”

Section 1. Legislative findings:
 
1. Mercury is an acute neurotoxin which harms the developing brain of a child or fetus.
  
2. A dental amalgam commonly referred to as a ”silver filling,” consists of 43 to 54 percent mercury.
  
3. Each dental amalgam contains about the same amount of mercury as is present in a mercury thermometer, about ½ to ¾ of a gram.
  
4. The mercury in a dental amalgam continually emits poisonous vapors.
 
5. The government of Canada warns that pregnant women or children under six should not receive a mercury filling.
 
6. According to various manufacturer warnings, the Agency for Toxic Substances and Disease Registry of the Public Health Service, and the Institute of Medicine of the National Science Foundation, children, including those still in the womb, are at particular risk for exposure to mercury contained in dental amalgam.
 
7. According to the Agency for Toxic Substances and Disease Registry, the mercury from amalgam goes through the placenta of pregnant women and through the breast milk of lactating women, giving rise to health risks to an unborn child or a baby.
 
8. Consumers and parents have a right to know, in advance, the risks of placing a product containing a substantial amount of mercury in their mouths or the mouths of their children.
 
9. Alternatives to mercury-based dental fillings exist, but many publicly and privately financed health plans do not allow consumers to choose alternatives to mercury amalgam.

Section 2. No device containing mercury shall be implanted into the teeth of a pregnant woman, lactating women, or child under six.

Section 3. Each dental office shall post a sign in plain view which states: “Dental amalgam contains approximately 50 percent mercury, an acute neurotoxin.” Before a filling is administered, each dentist shall hand the patient a sheet which states the same information.

 Section 4: A dentist may recommend, after consultation with the beneficiary, a dental restorative material other than the covered benefit of amalgam, and may claim and receive the reimbursement rate for an amalgam restoration when using a different dental restorative material.

Section 5:  The effective date of this statute shall be __________, 2005.
